Beware of Chinese Domain Names Fraud
Many voices in the blogosphere have reported a new scheme of scam involving generally a Chinese domain registration firm asking for people to register some domain names through them because “a third party” was trying to register them. An example would be a dot.com domain owner who would receive an unsolicited email from those bogus companies because of someone else trying to register some .cn versions of the same website, so they wanted the company owner to register these domains first with them to “protect their trademarks”.
There is no such a thing as a registrar contacting a company because a third party was trying to register a similar domain name. Chinese domain name can be registered both in China and overseas and immediately, provided that they are available at the very moment the search is conducted. On the other hand a domain name doesn’t automatically make a trademark owner unless related to a brand which has been properly registered with the country’s relevant organizations, and in which case the trademark would apply solely to that specific country.
Make sure not to fall for this scam. Nevertheless, if you have China-related operations or expect to be involved with China in the near future, it would make sense to register and park the Chinese extensions (.cn and .com.cn would do) of your domain if available, to avoid it being snapped by domainers, competitors or even scammers as the ones we just mentioned.
Below an email correspondence received by a client (whose website is www.shanghai-tv.com.cn) that would give you a clearer pictures of what is going on.
From: Liza <Liza@netinchina.org.cn>
Subject: Shanghai-tv-Intellectual property rights (TO CEO)
Dear CEO,
We are the domain name registration organization in China, which mainly deal with international company’s in china. We have something important need to confirm with your company.

If you do not know this company, we doubt that they have other aims to buy these domain names. Now we have not finished the registration of Viva company yet, in order to deal with this issue better, Please contact us by telephone or email as soon as possible.

January 8th, 2008 at 10:10 am
Very useful indeed. Seems like domaininasia.net is racing for survival, or at least their sales pitch is not very honest. We’ve just received a similar mail for our .asia and .hk domain names from hebe.chen@domaininasia.net
January 8th, 2008 at 10:53 am
Thanks for the comments. In fact it is probably the same company (or similar bogus hosting firms) who are trying to rip off people by using new identities. A quick whois look up reveals that both domaininasia.org and domaininasia.net have been registered on January 2nd, 2008…
January 8th, 2008 at 11:02 am
I think I have just unmasked the scammers. As foolish as they were, they replied to this post (probably because it was coming high while googling for their company name), as Tom Cao (tom.cao@domaininasia.org) and Dina Wang (DiNa@netinchina.hk). On purpose I have approved some of their comments in this thread. Their IP has been logged and IS THE SAME, 59.181.107.170.
Now the most interesting part. I have done a reverse look up on this IP address using this IP address locator and it seems that the emails were sent from…MUMBAI, INDIA
Once again be very careful when dealing with this scammers! Make sure to inform people at risk not to fall for this.
Now, to “Tom Cao” and “Dina Wang”, if you guys (probably the same person though) are back again to this thread, how can you explain:
1-That emails from both domains and pretendedly different firms were sent from the same IP?
2- How come your IP address shows that you are in India while you pretend being HK/Chinese companies?
3-How do you explain that your website is less than a week old and however try to pose as an “established company”?

We just got the same scam from “Steve Hua” of “MP-China.org.cn” and “Shanghai MP Network Solutions Co., Ltd.”
January 10th, 2008 at 2:31 am
My business partner forwarded an identical message from Tom Cao. I was in the midst of responding when I stopped to Goolge Viva Int’l. which brought me here. I intend to inform Mr Cao (or whoever is behind the nom de net) that such registrations would violate the US Anti-cybersquatting Piracy Act, a federal law that prohibits use and/or registration of registered trade and domain names and those deceptively similar thereto. He’s unlikely to be impressed because he’s undoubtedly beyond the jurisdiction of the US courts.
That said, I query what is their angle? If I want to register first-order domain names with country-specific extensions, I don’t need “Asia DNR.”
Guess it’s just the scam de jure. Thanks for the info. Cheers!

“Your correct response is to report this immediately to the CNNIC by emailing the correspondence with your suspicions to service@cnnic.cn.
The CNNIC is the China Internet Network Information Centre which regulates domain names in China. Visit them at http://www.cnnic.cn/en/index/index.htm - all the rules and regulations for China Domain Names are spelt out here, and you can email them direct from the site. They are not amused by this, and will likely take action.

Thanks to Kodjo for commenting on our blog where we had posted about this for a second time. http://www.rentaspider.com/2008/01/domain-name-adds-supplemental-notes.html
It may be that the scammers are in India, or as I responded they may only be trying to appear that they are in India. In either case a Chinese registrar is involved and so we will continue to call this a “Chinese scam” until the facts can be known. Frankly, I was surprised that something like this COULD be from China, but there are criminals everywhere, arn’t there…? I am subscribing to be notified of futher comments posted here and will update my blog as needed when the scam is ended and the scammers locked up. It is good they are reading the messages here, so they can start to understand what they are doing is dishonest and wrong!
And thanks for the tip about the address for service @ cnnic.cn. I have forwarded them the message with the headers so they can take action.

Thanks for all the information I also received the following email and was responding and even trying to seek legal advice on the matter fearing our business was going to suffer. I feel much better after finding this site.
Thank you for your letters in reply
Are you sure that you have no relation with Hutmyt Holdings Ltd? If so, the Hutmyt Holdings Ltd may register these domain names compete first.
Just because of your registered trademark, so we inform of your company. But the domain names registration is open in the world.
This is international domain name registration principle. We are only a domain name registration organization in China, We have no right to prevent other people’s registration. So required by China government to inform your company to protect your interest. As the company whose trademarks relateto the applied domains, you will get the priority to register these domain names and Internet brand name.
If you think these domain names and Internet brand name are useful for you, we can send an application form to you and help you register these within dispute period. If you don’t think their application will affect your benefit, we will pass their application. There is a time limit. Pls let us know your decision soon.
We knew you have registered the domain name “glosscrete.com.au” and own the intellectual property (own the trademark Glosscrete ). This is why we informed you. But now Hutmyt company wanted to apply for other domain names and internet brand you have not registered yet.
Waiting for your further reply as soon as possible.

Yeah. Got one too.
Our company received similar email from someone named Amy Chen. I feel for it at first, and to protect our company’s identity, we actually called and wrote to them to confirm this matter. All she said was, if you don’t want people to steal the identity, I will send you a quotation so that you can reserve your domain and identity. Suprise, surprise! The price she sent us was triple of what we normally pay for all of our domains. After months of ignoring their price quotation, I received another one today:
Subject: [*SPAM*] Re: keep quiet all the time
Dear Miss/Sir
I am very sorry that you handle this matter with such attitude. I can’t contact you for such a long time. I also don’t know where is the key problem is.I just want to help you protect intellectual property right instead of you would do as what I said to you. You own the preferential right to register these domain names, but it does not mean it belongs to you. If you think they are not important for you, you can abandon and we will register for Universe Limited Company.Once Universe Limited Company apply successfully, the possess right of these domain names belongs to Universe Limited Company not yours. That means you will lose the market in these domains. It becomes the key point of why the global domain names becomes so important. For it affects whether a company brand can exist or not.If you think we are helping you, pls contact us asap for the dispute time is almost at its end. Pls tell us your decision so that we can handle the next step.

Amy Chen

Now they are attempting to threaten with legal action when I ignored their emails…
Dear Jason,
we have already finished the registration for you, but now you don’t want to pay,I feel very angry. We have dealt with lots of clients like you and never worry about this. I have forwarded this matter to our legal department, you will receive the court summons soon. We will use the application form with your signature and the conversations to prosecute. I think the prosecute costs won’t be less than the registration fees. What’s more, we will put our action on Google and will screen your asia market to let all of the world people know your company. at the same time, we are selling these domains on the website http://www.domainpricing.com.I believe there must be many people would like to pay for these domains.

We just received this one:
Dear
We received a formal application from a company who is called Saibo Investment Co.,Ltd is applying to register ” Cwcdirect ” as their domain name in China as well as in Asia on July 1, 2008 1, 2008. During our auditing procedure we find out that the alleged Saibo Investment Co.,Ltd has no trade mark, brand nor patent even similar to that word. As an authorized anti-cyber squatting organization we hereby suspect the alleged Saibo Investment Co.,Ltd to be a domain grabber. Hence we need your confirmation for two things, `
First of all, whether this alleged Saibo Investment Co.,Ltd is your business partner or distributor in China.
Secondly, whether you are interested in registering these domains (The alleged Saibo Investment Co.,Ltd will be entitled to obtain a domain not needed by original trademark owner.)
If you are not in charge of this please transfer this email to appropriate dept.
This is a letter for confirmation. If the mentioned third party is your business partner or distributor in China please DO NOT reply. We will automatically confirm application from your business partner after this audit procedure.

I’m a deputy of one foreign enterprise in China, last year we protected our domains by Beijing hkzc Co.,Ltd and prevent others grabbing successfuly, our business shows a huge increasing and pepole know more about our products and company via the new domains regsitration. so I think whether it’s fraud or not, the key is whether you realize the domain registration is important or not for you now days.
July 4th, 2008 at 8:34 pm
To Gavin:
What do you mean actually by “protected”? Paying hundreds of dollars for domain names that should cost less than $10 each? What is the difference with registering them with a regular registrar and not someone who promotes his services through mass email?
Looking forward to your reply. If not I will just assume that you are one of those scammers.

Our company just got one of these. This the third one we’ve received this year. Names are always different but goal seems to be the same, scamming you out of money.
We received a formal application from a company who is called Meiao Investment Co.,Ltd are applying to register “XXXXX” as their domain name and Internet keyword in China and also in Asia on Aug 08 2008. During our auditing procedure we find out that the alleged Meiao Investment Co.,Ltd has no trade mark, brand nor patent even similar to that word. As authorized anti-cybersquatting organization we hereby suspect the alleged Meiao Investment Co.,Ltd to be a domain grabber. Hence we need you confirmation for two things.
First of all, whether this alleged Meiao Investment Co.,Ltd is your business partner or distributor in China.
Secondly, whether you are interested in registering these domains. (The alleged Meiao Investment Co.,Ltd will be entitled to obtain a domain not needed by original trademark owner.)
If you are not in charge of this please transfer this email to appropriate dept.
This is a letter for confirmation. If the mentioned third party is your business partner or distributor in China please DO NOT reply. We will automatically confirm application from your business partner after this audit procedure.

I got one from “Brent Lee” as well and have grabbed a couple of the domains he listed from GoDaddy (.net, .org). I fell for it initially - thanks for putting this information out there. I was planning to call my attorney tomorrow - I really thought this was legit.

I have recently received e-mails from someone calling himself Brent, whose e-mail addresses are Brent@asiadnr.org.cn and brent@westnet.hk.cn. The wording of the initial e-mail was IDENTICAL to that of e-mails cited elsewhere in this stream, except for the different company and domain names. I asked for further information and received a price list that would have cost me nearly $2,000 to lock up the dozen or so domain names mentioned. Following this, “Brent” has sent me a half-dozen e-mails asking me to confirm receipt and to let him know when I would send the completed application form and payment back to him, and this morning he called me, ostensibly from Hong Kong, asking me when he could expect my response. This is clearly a scam, far more modest in scope than the Nigerian 419 advance fee frauds, but as seems to be characteristic of Chinese businesses they sell relatively cheap and make money on the volume. If I get another one of these I plan to write back saying I am the nephew of a deposed African dictator requiring help getting $20 million out of my country in exchange for which I will give him 1/3 of the proceeds.

My Advise is to look for evidences:
Try to find the suposed Company interested in registering the domains.
—>It does not exist.
Try to google for general message subjects, linking them whith fraud.
—>Several evidences will apear for sure.
Go to the registar website and you’ll find that:
Is very poorly deploied and has only general info not especific info.
Also try to do a Whois for the registar mail sub domain and site domain.
See if has something to do with this Whois Record:

After we received the application from YU-Online (Hongkong) Company, we checked that “redcart” is your company’s trademark. That’s why we sent email to you.
The following domain names are applied by YU-Online (Hongkong):
[1] DOMAIN NAME
l ********.cn / ********.com.cn / ********.org.cn / ********.net.cn
l ********.hk / ********.com.hk
l ********.asia
[2] INTERNET BRAND NAME (INTERNET KEYWORD):
l ********
[3] CHINESE DOMAIN NAME:
l ********
[4] WIRELESS WEBSITE:
l ********
Please note the following information:
“.cn” “.com.cn” “.net.cn” and “.org.cn” are top level domain names in China. “.com” “.net” “.biz” and “.info” are International top level domain names.
Internet brand name is one of domain names, which has no prefix “www.” and no suffix “.com”. It is the extension of real world’s brand on the web. After succeed in registration, these domain names will be authorized and ruled by official organization. Meanwhile, electronic register certificates will be awarded to the registrant from official organization to protect their ownership of these domains.
You must know that every party have right to register any domain name without authorization. Domain name takes open registration. This is international domain name register principle. For example, google.com.cn & google.cn had been registered by other company. And Google had to pay 1 million dollars to get these two domains back.
According to the rule, YU-Online (Hongkong) company allowed to register these domain names. But your company has the priority to register these domain names. So we sent an email to inform your company to remind you. If you don’t want these domain names to be used by YU-Online (Hongkong) company, you need register them in your own name. If you don’t need these domain names, we have to register them for YU-Online company.
Please let us know what’s your decision of this matter, and what further assistance we can offer you .
If you have further questions, please do not hesitate to contact us directly.
